The OFT has recently published Mental Capacity Guidance.  Closely aligned with the OFT’s Irresponsible Lending Guidance, the new guidance is intended to help lenders and their representatives assist borrowers who may have mental capacity limitations in making informed borrowing decisions. The workshop speakers will examine the issue from legal, regulatory, compliance and mental health perspectives and will help firms familiarise themselves with the guidance.


By the end of the workshop delegates:

  • Should expect to have a good understanding of the new guidance
  • Will know what steps the OFT expect creditors to take when dealing with borrowers understood to have, or suspected of having, mental capacity limitations
  • Know how mental capacity differs from mental health difficulties
  • Will have an understanding of the legal implications and the law relating to the guidance
