This one day course offers creditors an opportunity to fully understand the legal framework that governs the motor finance sector and examines in detail how legislation such as the Consumer Rights Act, Sale of Goods Act and the Supply of Goods Act define the creditors’ obligations to their consumer credit customers.
Course content includes:
- The different types of contracts that lenders use and their impact on lenders’ obligations and the rights of consumers
- The Financial Conduct Authority’s regulatory regime for consumer credit
- The role of a manufacturer’s warranty
- The Hire Purchase Act 1964, the Sale of Goods Act 1979 (as amended), the Supply of Goods and Services Act 1982 and the Supply of Goods (Implied Terms) Act 1973
- Terms implied into contracts, including satisfactory quality, fitness for purpose, description and ownership
- An overview of current consumer credit legislation, including terminating regulated agreements, issues affecting the recovery of assets and debts, connected lender liability, and the impact of the debtor’s right to withdraw from a credit agreement
- An overview of current consumer credit rules and legislation claims against third parties for the recovery of goods
